Actress Swara Bhaskar married SP leader Fahad Ahmed on Thursday. Surprised everyone by announcing marriage on social media. Like inter-religious couples, Swara and Fahad also got married under the Special Marriage Act 1954. Announcing this on Twitter, Swara wrote, " Three cheers for the Special Marriage Act , at least it exists." It gives a chance to love. What is Special Marriage Act?

The Special Marriage Act (SMA) was passed on October 8, 1954. It is related to civil marriage, in which the state approves the marriage instead of religion. If you understand in simple language, in the Muslim Marriage Act 1954 and the Hindu Marriage Act 1955, either of the two partners have to convert before marriage, but this does not happen in the case of the Special Marriage Act.

In the case of a marriage registered under the Special Marriage Act, before marriage, neither of the two partners have to leave their religion, that is, they do not have to convert. Both civil and religious marriages are recognized in India. It is similar to the Marriage Act 1949 of Britain. The Special Marriage Act was first implemented in India in 1872, but with some changes it was implemented for the last time in 1954.

What is the whole process?

Under Section 5 of the Special Marriage Act, it is mandatory for the couple getting married to give written notice to the marriage officer of the district 30 days before the wedding. It is also essential that where registration is being done for marriage, one of the two partners should be a local resident of that district.

After submitting all the necessary documents, it is mandatory for both the parties to be present for issuing the notice. One copy of the notice is displayed on the office board and two copies are sent by post to both the parties at the given address. This notice is for 30 days. If no objection is filed during this time, then it is officially recognized after both the partners sign the documents.

Before getting married, both the parties are required to present 3 witnesses before the marriage officer. Their names are also mandatory in the documents. Once the marriage officer accepts the documents, the marriage is solemnized and the marriage certificate is given to the couple. This is proof of marriage.
