Former judge said - Supreme Court hijacked the constitution, Rijiju said - this is a noble voice


Earlier, Union Law Minister Kiren Rijiju had written a letter to CJI DY Chandrachud and suggested the inclusion of government representatives in the High Court and Supreme Court collegiums.

The Center and the Supreme Court are at loggerheads over the appointment of judges . Meanwhile, Union Law Minister Kiren Rijiju shared a clip of a retired judge of the Delhi High Court on Twitter. In this clip, retired judge RS Sodhi is saying about the collegium system of the Supreme Court that the Supreme Court has hijacked the Constitution for the first time. He said that we will appoint the judges ourselves and the government will have no role in this. Rijiju writes on this, 'The noble voice of a judge.'

Rijiju tweeted the video and wrote, "The noble voice of a judge. The real beauty of Indian democracy is its success. The people rule themselves through their representatives. Elected representatives represent the interests of the people and make laws. Our judiciary is independent, but our constitution is supreme."

In another tweet, Rijiju said that in fact most of the people have similar views. He named the Supreme Court Collegium system and said that it is only those people who disregard the provisions of the Constitution and the mandate of the people and think that they are above the Constitution of India.

High Court is not subordinate to the Supreme Court – Justice Sodhi

In an interview uploaded on November 23 to Law Street India's YouTube channel, Justice Sodhi says, “The High Court is not subordinate to the Supreme Court. Rather, the High Court is an independent body of the respective states. What's happening now. Now the Supreme Court is appointing the judges of the High Court and now the judges of the Supreme Court come from the High Court. That's why the judges of the High Court have now started looking towards the Supreme Court. He has become subordinate to the High Court."

Judges are appointed through collegium

The Collegium is a 25-year-old system through which judges of the Supreme Court are appointed to the Supreme Court and High Courts. The current Collegium comprises Chief Justice of India DY Chandrachud and Justices SK Kaul, KM Joseph, MR. Shah, Ajay Rastogi and Sanjeev Khanna.
