Unmarried women also have the right to have an abortion for 24 weeks, understand the meaning of the decision?

The Supreme Court, while giving a big decision, has given the right to a safe abortion to married and unmarried women.

Hearing in the case of marital rape , the Supreme Court has said that under the Medical Termination of Pregnancy Act , rape should include marital rape' . The Supreme Court has observed during the hearing that if husbands sexually assault women , it can take the form of rape. The Supreme Court, while giving a big decision, has given the right to a safe abortion to married and unmarried women. The Supreme Court said that all women have the right to a safe abortion. The apex court has made major changes in the Medical Termination of Pregnancy Act.

The Supreme Court said that every woman has different circumstances. In the event of a disaster, a woman can definitely decide to have a child. However, during this time the Supreme Court also made it clear that in case of emergency, any woman can decide on pregnancy whether she wants that child or not. It comes under the special rights of women.

In this hearing, the Supreme Court, while commenting on the special rights of women, said that if the marital status of a woman is forcing her to conceive an unwanted pregnancy, then it is not proper. The Supreme Court made it clear that marital status cannot deprive a woman of the right to abort an unwanted pregnancy. The top court has also talked about the rights of unmarried women. The Supreme Court said that any woman who is unmarried also has the right under the Medical Termination of Pregnancy Act to have an abortion within 24 weeks under the rules.

Major changes in Medical Termination of Pregnancy Act

The implication of this decision of the Supreme Court is that now even unmarried women have got the right to abortion up to 24 weeks. SC has extended Rule 3-B of the Medical Termination of Pregnancy Act. In normal cases, the right of abortion for pregnancy above 20 weeks and less than 24 weeks was till now only for married women, which now also got unmarried.

What is the matter

A petition was filed in the Supreme Court regarding marital rape. The petition was filed by a woman named Khushboo Saifi challenging the fractured decision of the Delhi High Court. The matter was heard on May 11. Two judges had expressed different views in this matter by the Delhi High Court.
