Whether there is divorce or not, the husband has the right to know the income of the separated wife, this is the rule

Recently, the news of Shikhar Dhawan's divorce caught people's attention. His wife remained separated from him for a long time after marriage, and even kept their child away from him. There are many social and family reasons for the breakdown of any marriage, but nowadays financial problems are also an important reason for divorce. In such a situation, does the husband have the right to know the income of his wife in the relationship between husband and wife who are living separately even before divorce? What do the rules say about this? Let us know...

Marriage couples are made by God, today's generation does not particularly agree with this statement. Rather, nowadays couples check compatibility and set life and financial goals before getting married. In such a situation, when a marriage breaks up, there are social and family reasons for it, but financial reasons also play their role. Divorce not only causes mental stress to couples, but it also causes a lot of financial stress. In such a situation, does the husband have the right to know the income of the wife who is living separately from the husband before divorce? Let us know what the rules say about this…

There is not much awareness among the people regarding the rights of the husband in divorce cases. In India, the rules and regulations of divorce are different in every religion. Whereas in most cases of divorce, the financial stress falls on the husband only, because it is his responsibility to pay maintenance and alimony. However, in some cases, under the Hindu Marriage Act, the husband can also ask for maintenance and alimony from the wife. In such a situation, the right to know the wife's income can reduce the husband's financial stress in divorce cases.

What does the law say on rights?

Recently the Central Information Commission (CIC) has given a big arrangement. CIC says that a husband can ask for information about the normal income of his wife living separately from him. For this, he can use the Right to Information and can use it as evidence in the case of maintenance in divorce cases.

In a case of Yash Malhotra vs Income Tax Department, Information Commissioner Saroj Punhani has given a big decision in this regard. He directed the Central Public Information Officer (CPIO) under the Income Tax Department to provide information about the net taxable income or gross income of the estranged wife.

The Information Commissioner said that the CPIO should provide this information to the husband within 15 days of receiving the order. He should provide the husband free information about his wife's income for the specific period sought in the RTI. After completion of this work, its information should be given to the Commission within 7 days.

What will be the effect of this decision?

The effect of this decision of the Central Information Commission can be seen in the long term. This decision can reduce the cases of fake maintenance in divorce cases. On the other hand, if the husband refuses to give information about his income, then the wife can also be given the facility to find out about his income by using the right to information.
