Male-female transgenders have the right to marry each other - Supreme Court


On the demand of giving legal recognition to gay marriage, CJI Chandradud today said that gay marriage cannot be accepted as a fundamental basis, but male-female transgenders have the right to marry each other. He said that if this is not allowed then it will be a violation of the Transgender Act.

CJI DY Chandrachud said a big thing while reading the decision in the Supreme Court today on the demand to give legal recognition to gay marriage. The CJI said that if a transgender person wants to marry a heterosexual person then such marriage will be recognized because one will be a man and the other will be a woman. A transgender man has every right to marry a woman.

If permission is not given, there will be violation of Transgender Act – CJI

The CJI said that similarly, a transgender woman has the right to marry a man and a transgender man has the right to marry. The CJI said that if such couples were not allowed to marry, it would be a violation of the Transgender Act. The CJI said that thus an unmarried heterosexual couple can marry to fulfill the need, but a homosexual person does not have the right to do so.

Create a hotline for the gay community.

Create safe homes for gay couples

Do not harass the gay community in the police station – CJI

The Supreme Court said that no harassment will be caused to the gay community by calling them to the police station merely to inquire about their sexual identity. Police should not force homosexual persons to return to their original families.
