The Karnataka High Court passed an interim order staying the complaint filed by a woman. The woman had alleged that her husband raped her after the wedding day. The woman had stayed with him only for a day. The High Court stayed the criminal proceedings against the husband and his family members, saying that even after looking at this case, you do not think that the law has been misused, then there can be no better example than this.
The husband and his relatives challenged the complaint filed by the woman and the registration of the case under various sections of the Indian Penal Code (IPC) and approached the Karnataka High Court. Both used to work together in an MNC motorbike showroom in Bangalore. They got married on January 27, 2023 in a temple. Before this, they were dating each other for four years. They got the marriage registered in front of the marriage registrar in Malleswaram. Wife's birthday was also celebrated on the same day.
Meanwhile, the husband allegedly came to know about the woman's earlier affair and her being in contact with another person through WhatsApp. The next day there was an argument about this and the wife left her in-laws house and went to her maternal home on 29th January. The High Court said that it is believed that the woman first threatened to end the marriage with the young man. There was no conversation between the two for about 32 days. Thereafter, the complainant made the allegations by filing a complaint before the jurisdictional police.
