Avoid making such statements when the matter is in the court - SC said on the petition related to Muslim reservation


SG Mehta told the Supreme Court that any religion-based reservation is unconstitutional. Advocate Dave, keeping his side, said that it was not a reservation based on religion.

New Delhi: On a petition filed against the state government's decision to abolish the system of 4 percent reservation for Muslims in Karnataka, the Supreme Court said that when the matter is pending in the court, statements related to it should not be made. While continuing the interim stay on the order, the Supreme Court adjourned the hearing till July 25.

During the hearing of a petition challenging the decision to end reservation for Muslims, the Supreme Court questioned the statements made by Home Minister Amit Shah in Karnataka. Along with this, the court also said that such statements should not be made when the matter is pending. SG Tushar Mehta said that we have demanded to postpone the matter.

It's contempt of order: Lawyer

The bench said that the interim order can be extended for the next period. Senior advocate Dushyant Dave, keeping his side, said that the honorable judge can say this till further orders, but every day the Home Minister says that we have finished it. While SG Mehta is representing the same party, it is contempt.

On this, SG Mehta said, "I cannot give a political reaction." Expressing displeasure, Justice Nagaratna said that if it is true then why are such statements being made? This should not be done on behalf of the officials sitting on public posts. When the matter is pending in the court and is before this court, such statements should not be made.

Religion based reservation unconstitutional: SG Mehta

Advocate Dave said, “I will put the statement on record. Amit Shah said the same on Monday. SG Mehta knows everything." Justice Nagaratna said that we are only saying that this should not happen.

SG said that Lordship will have to confirm. Can't let it become a fish market. Justice Joseph said that we cannot allow such politicization. When we are ready to listen, we were ready before to listen. The next hearing of the case will be on July 25.

In the last hearing, the state government had assured the Supreme Court that till April 25, people belonging to Vokkaliga and Lingayat communities would not be given any benefit of quota in admission to educational institutions and appointment in government jobs.
