Is society ready to listen to this? - Kapil Sibal said amid SC hearing on same-sex marriage

A new proposal was presented in the Supreme Court by the Center in which it was argued that the petitioners cannot claim same-sex marriage as a fundamental right.

New Delhi: For the last few days, former Union Minister Kapil Sibal is continuously active. This time , in the midst of a hearing in the Supreme Court regarding legal recognition of same-sex marriages, Sibal asked whether our society is ready for this? A hearing is being held in the Supreme Court on Tuesday regarding same-sex marriage.

Former Union Minister and Rajya Sabha MP Kapil Sibal today tweeted a question about gay marriage. He said gay marriage. The Supreme Court is ready to hear arguments related to legal recognition of same-sex marriages, but is our society ready to hear it?

A five-judge bench of the Supreme Court, headed by Chief Justice DY Chandrachud, will hear all appeals related to legal recognition of same-sex marriages on Tuesday. Apart from CJI Chandrachud, 4 other Justices SK Kaul, S Ravindra Bhat, Hima Kohli and PS Narasimha are included in this bench.

Hearing is being held after about 15 petitions

The matter related to same-sex marriages is being heard after at least 15 petitions, which were referred to a larger bench on March 13 last month, taking an official decision from the CJI-led bench, saying That this is a "very seminal issue".

In order to consider homosexuality as normal in the country, there has been a constant demand for giving legal recognition to same-sex marriages. Especially after the decriminalization of Section 377 of the Indian Penal Code in 2018, this demand has intensified.

Court should refrain from passing judgment on this matter: Center

However, this idea has been continuously opposed by the central government, and its request to give legal recognition to these marriages is indicative of the thinking of the urban nobles.

The Center on Sunday moved a fresh proposal in the Supreme Court in the matter, arguing that the petitioners cannot claim same-sex marriage as a fundamental right.

In the new application filed in the court on behalf of the Center, it was said that this type of marriage reflects the thinking of the urban elite and recognition of such marriage is essentially a legislative act, which should be refrained from passing judgment.
